costarricenses<\/strong><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>Costa Rica no tiene una entidad que defienda y proteja a los consumidores cuando se presentan abusos o situaciones relacionadas con productos financieros, este es uno de los principales elementos conclusivos de un conversatorio sobre el endeudamiento de los hogares costarricenses desarrollado en el Colegio de Abogados y Abogadas de Costa Rica.<\/p>\n\n\n\n<p>La actividad fue organizada por el Sindicato Nacional de Enfermer\u00eda (Sinae) y Afines donde cont\u00f3 con la participaci\u00f3n de representantes de sindicatos de entidades financieras, especialistas en litigio en materia de derecho financiero, un juez que abord\u00f3 la nueva ley de materia concursal y uno de los voceros de la nueva organizaci\u00f3n Omercrom.<\/p>\n\n\n\n<p>Fue justo la participaci\u00f3n de David Carrera, del sindicato del Banco Nacional y de la presidente de la Asociaci\u00f3n de Protecci\u00f3n y Defensa del Consumidor (Aprodeco), Adriana Rojas de d\u00f3nde se extrae la necesidad de una nueva ley en materia de derecho financiero.<\/p>\n\n\n\n<p>En estos momentos m\u00e1s de la mitad de los hogares costarricenses presentan alg\u00fan grado de endeudamiento, y seg\u00fan Carrera lo preocupante es el volumen creciente de colocaci\u00f3n de cr\u00e9dito de consumo entre la poblaci\u00f3n, mucho fuera de los aspectos de regulaci\u00f3n y vigilancia de las entidades supervisoras.<\/p>\n\n\n\n<p>Carrera extern\u00f3 que justo las entidades reguladas s\u00ed est\u00e1n en la procura de tutelar y garantizar que los consumidores en necesidad de productos de cr\u00e9dito demuestren su capacidad de pago, sin embargo esa premisa no se cumple en todos los colocadores de cr\u00e9dito de consumo masivo que es el comportamiento dominante presente.<\/p>\n\n\n\n<p>\u201cLa ley de usura es una buena herramienta que estoy convencido de que requiere reformas integrales para poder darle m\u00e1s sustento a esa defensa del consumidor financiero frente a los fen\u00f3menos que observamos hoy en el mercado financiero\u201d, puntualiz\u00f3.<\/p>\n\n\n\n<p>Mientras tanto ante la carencia de esa oficina que proteja los derechos de los consumidores en temas financieros la abogada Rojas Rivero afirm\u00f3 que dicha oficina debe existir al \u00e1mparo de las entidades encargadas de la supervisi\u00f3n del sistema financiero.<\/p>\n\n\n\n<p>\u201cEn Costa Rica solo la Sutel es la \u00fanica superintendencia con capacidad de investigar y sancionar a los operadores en caso de que se logre demostrar actos que perjudiquen al consumidor de telecomunicaciones, en efecto ese modelo debe replicarse dentro de las superintendencias que velan por el cumplimiento de normativas en el \u00e1mbito financiero\u201d, explic\u00f3.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"720\" height=\"405\"
